Overview
The Care Home Manager requested advice on managing an employee who had certified as unfit for work due to stress. This employee had then posted pictures of themselves on Facebook on an unauthorised holiday abroad during this period of sickness. These facebook posts had also made defamatory comments about the employer and the employer therefore questioned the legitimacy of the absence.
Initially, the support from Pathway Partner was over the phone, using our unlimited telephone guidance service. This included initial discussions re gathering evidence and possible approaches. Having concluded that an investigation was necessary, we developed the questions and attended the investigation meeting, developed the evidence pack for the disciplinary hearing and conducted the hearing itself, alongside the Care Home Manager.
We then produced the necessary paperwork to terminate the employee’s contract due to summary dismissal.
