Overview

Our client, who we work with on a monthly-retained basis, phoned the telephone helpline asking for guidance following a call from the LADO (Local Authority Safeguarding Officer).

The call was in relation to the conduct of one of the Nursery employees and was linked to a safeguarding concern; the employee was on Police Bail and still attending work and had failed to notify the employer of their arrest.

We made contact with the police to view evidence relating to the employees’ impending prosecution and supported the Nursery Manager to facilitate a suspension, disciplinary investigation and subsequent hearing.  The employee was summarily dismissed from their employment based on a breach of trust by failing to execute their duty to notify the employer of their arrest.
